Mingolive Terms of Use and End User License Agreement

Welcome to Mingolive. These Terms of Use and End User License Agreement (the "Terms") form a binding agreement between you and Mingolive regarding your access to and use of the Mingolive website, mobile applications, live features, messaging features, content, products, and related services (collectively, the "Service"). In these Terms, "Mingolive," "we," "us," and "our" refer to the operator of the Service.

By creating an account, signing in, selecting the acceptance checkbox, or using the Service, you confirm that you have read and accepted these Terms and our Privacy Policy. If you do not accept them, do not register, sign in, or use the Service.

1. Eligibility and Accounts

You must be legally permitted to use the Service in your country. If you have not reached the age at which you may consent to online services in your country, you may use Mingolive only with the permission and supervision of a parent or legal guardian. The Service must not be used by anyone prohibited from receiving it under applicable law.

You agree to provide accurate information, protect your password and account credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law. You may not sell, transfer, impersonate another person through, or create an account for abusive, deceptive, or unlawful purposes.

2. User-Generated Content

The Service allows users to create or share posts, comments, messages, profiles, photos, audio, video, livestreams, reviews, reactions, and other materials ("User Content"). You retain ownership of your User Content and are responsible for it.

When you submit User Content, you grant Mingolive a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt for technical formatting, display, distribute, and make the content available only as reasonably necessary to operate, secure, improve, and promote the Service. This license ends when your content is deleted, except where the content was shared by others, must remain in backups for a limited period, or must be retained for security, legal, or regulatory reasons.

You confirm that you own your User Content or have all permissions necessary to submit it, and that its use through the Service will not violate another person's rights or any applicable law.

3. Safety Standards and Prohibited Content

Mingolive has zero tolerance for abusive users and objectionable or unlawful content. You must not create, upload, stream, send, promote, or engage with content or conduct that:

  • sexually exploits or endangers a child, depicts child sexual abuse, grooms a minor, or requests sexual content involving a minor;
  • contains pornography, explicit sexual activity, prostitution, human trafficking, or non-consensual intimate material;
  • threatens, glorifies, or encourages violence, terrorism, dangerous activity, suicide, self-harm, or harm to people or animals;
  • harasses, stalks, bullies, intimidates, blackmails, humiliates, or threatens another person;
  • promotes hatred or discrimination based on race, ethnicity, nationality, religion, disability, age, sex, gender, sexual orientation, or another protected characteristic;
  • is defamatory, fraudulent, intentionally deceptive, impersonates another person, or manipulates users through scams or false information;
  • offers illegal or regulated goods or services, including prohibited weapons, drugs, or unauthorized financial activity;
  • violates privacy, exposes personal or confidential information, or contains imagery or recordings captured without required permission;
  • infringes copyright, trademark, publicity, or other intellectual-property rights;
  • contains spam, malware, malicious code, unauthorized advertising, automated engagement, or attempts to manipulate Service metrics; or
  • otherwise violates applicable law, these Terms, or the safety of the Mingolive community.

You may not use Mingolive to arrange illegal activity, evade enforcement, interfere with the Service, scrape or harvest user data, gain unauthorized access, or encourage another person to violate these Terms.

4. Moderation, Reporting, and Blocking

Mingolive uses technical controls and human review to filter, detect, and moderate objectionable material. These measures may not identify every violation, and users must use the reporting tools when they encounter harmful content or conduct.

You can report objectionable posts and abusive users through the in-app report actions. Reports are sent to Mingolive's moderation system for timely review. You can also select Block and Report User from another user's post or profile. Blocking notifies our moderation system of the reported conduct, prevents further unwanted interaction where supported, and removes that user's content from your feed immediately.

We may review, restrict visibility, remove content, disable features, preserve evidence, suspend or terminate accounts, or report matters to law enforcement or other authorities when we reasonably believe these Terms, community safety, or applicable law has been violated. Severe violations may result in immediate and permanent removal without prior warning. Repeated violations and attempts to evade enforcement may lead to permanent account termination.

Do not knowingly submit false, misleading, or abusive reports. For safety concerns or content requiring urgent review, contact us at admin@mingolive.com. If anyone is in immediate danger, contact local emergency services first.

5. Livestreams, Messages, and Interactions

The same safety standards apply to livestreams, private or group messages, comments, calls, and every other interactive feature. Do not share information that could put you or another person at risk. Mingolive does not endorse User Content and is not responsible for agreements, meetings, payments, or interactions arranged between users. Use appropriate caution when communicating with people you do not know.

6. Purchases, Memberships, and Digital Features

Some features may require a paid membership, digital purchase, or other in-app transaction. The price, duration, included benefits, and whether a product renews are displayed before purchase. Access to time-limited benefits ends when the displayed entitlement period expires unless a new purchase is completed.

Purchases made in the iOS or iPadOS application are processed through Apple's In-App Purchase system and are subject to the payment terms of your Apple account. Apple controls payment processing, billing records, and refund decisions for those purchases. Requests concerning an Apple-processed charge or refund must be submitted through Apple's support channels. Nothing in these Terms limits rights that cannot be waived under applicable consumer law.

You may not bypass an authorized payment mechanism, falsify purchase evidence, abuse refunds, or attempt to obtain paid features without payment. We may correct entitlement errors and investigate suspected payment fraud.

7. License to Use the Application

Mingolive grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the mobile application on devices that you own or control, subject to these Terms and the usage rules of the platform from which you obtained it.

You may not copy, redistribute, sell, rent, sublicense, reverse engineer, disassemble, attempt to derive source code, modify, or create derivative works from the application except where applicable law expressly permits it. You may not use automated systems to access the Service without our written permission.

8. Apple App Store Terms

If you obtained the application through Apple's App Store, these Terms are between you and Mingolive, not Apple. Mingolive, and not Apple, is responsible for the application, its content, maintenance, support, and handling of claims to the extent required by law. Apple has no obligation to provide maintenance or support services for Mingolive.

Your use of the application must comply with the Apple Media Services Terms and applicable App Store usage rules. Apple and its subsidiaries are intended third-party beneficiaries of this section and may enforce the applicable App Store provisions against you. Apple's standard end user license terms also apply to the extent they are not inconsistent with these Terms.

9. Privacy

Our Privacy Policy explains what information we collect, why we use it, how it may be shared, and the choices available to you. By using the Service, you acknowledge those practices. You must not use information obtained through Mingolive to track, identify, contact, or profile another user outside the purposes made available by the Service without valid permission.

10. Intellectual Property

Except for User Content, Mingolive and its licensors own the Service, software, branding, design, and related intellectual property. No right is granted except the limited license expressly stated in these Terms. If you believe content infringes your rights, send a detailed notice to admin@mingolive.com identifying the protected work, the allegedly infringing material, its location, your contact information, and the basis of your claim.

11. Third-Party Services

The Service may include links, integrations, advertisements, or services operated by third parties. Their own terms and privacy policies apply. Mingolive does not control and is not responsible for third-party content, availability, security, or practices. You are responsible for complying with any third-party terms that apply to your use.

12. Suspension, Termination, and Account Deletion

You may stop using Mingolive at any time and may request account deletion through the in-app account settings where available. We may restrict, suspend, or terminate access if reasonably necessary to protect users, comply with law, investigate abuse, prevent fraud, maintain the Service, or enforce these Terms.

Upon termination, your license to use the Service ends. Provisions that by their nature should survive, including content licenses already relied upon by other users, safety enforcement, intellectual property, disclaimers, limitations, and dispute provisions, will remain effective.

13. Service Availability and Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that every feature will always be available, uninterrupted, secure, or error-free, or that all User Content will be accurate or appropriate. We may modify, suspend, or discontinue features when reasonably necessary.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded. Where exclusions are permitted, Mingolive disclaims implied warranties to the maximum extent allowed by applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Mingolive will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, reputation, or business opportunity arising from use of or inability to use the Service. This limitation does not apply where liability cannot be limited by law, including liability arising from fraud, willful misconduct, or other legally non-excludable obligations.

15. Changes to These Terms

We may update these Terms to reflect changes to the Service, safety requirements, platform rules, or applicable law. The effective date will be updated, and material changes may be communicated through the Service or by other reasonable means. Continuing to use the Service after updated Terms become effective constitutes acceptance where permitted by law. If you do not accept an update, you must stop using the Service.

16. Applicable Law and Disputes

These Terms are governed by the laws applicable to the operator of Mingolive, without depriving you of mandatory protections available under the law of your place of residence. Any dispute must be brought before a court or dispute-resolution body with jurisdiction under applicable law. Before filing a claim, you are encouraged to contact us so we can attempt to resolve the issue informally.

17. General Terms

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without permission. We may transfer these Terms as part of a merger, reorganization, sale, or transfer of the Service, subject to applicable law.

These Terms, together with the Privacy Policy and any purchase disclosures shown to you, constitute the agreement governing your use of Mingolive.
